Exempt Providers

Virginia law requires most licensed physicians practicing in the Commonwealth to pay an annual Birth-Injury Program assessment, regardless of specialty, including physicians who do not provide obstetrical care. However, under Virginia law, certain physicians may be exempt from paying the annual physician assessment. To claim an exemption, submit the exemption affidavit form during the assessment process.

Qualifying Exemptions

The Commonwealth of Virgina allows for five qualifying exemptions:

    Government Employment: Physicians employed by the Commonwealth of Virginia or the federal government whose income from professional fees is less than 10% of their annual salary.

    Graduate Medical Educations: Physicians enrolled in a full-time graduate medical education program accredited by the American Council for Graduate Medical Education.

    Retirement from Active Practice: Physicians who have retired from active clinical practice.

  • 4

    Volunteer Services Only: Physicians whose active clinical practice is limited to providing voluntary, uncompensated care to patients at a clinic that delivers health care services at no charge.

  • 5

    No Practice in Virginia: Physicians who do not practice medicine in Virginia.
