Providers
The Virginia Birth-Related Neurological Injury Compensation Program is made possible through the partnership and support of Virginia’s healthcare community. Provider assessments, participating hospitals, and insurers all play a vital role in sustaining a program that provides lifetime care and support to eligible participants. Our hope is that participating providers never need the Program services they are entitled to, but when needed, the Program offers an effective alternative to costly malpractice litigation and the ability for providers to focus on patient care.

Participating
Providers
Physicians holding a valid medical license issued by the Commonwealth of Virginia can elect to participate in the Program. Participating providers experience protections related to catastrophic birth-related brain or spinal injury claims, credits to standard malpractice insurance premiums, and ensure patients receive lifetime support.
Exempt
Providers
You may be exempt from paying the assessments if you are fully retired, in a full-time residency/fellowship program, employed by the government, or practicing solely on a voluntary, uncompensated basis. Physicians claiming an exemption from the assessment under Virginia Code § 38.2-5020 should complete and submit the required affidavit.
